Kevin Feige explains why Ultron was chosen to assemble The Avengers.

"I first met James Spader two or three years ago. I thought it would be great to have him in our universe and we finally found the right role with Joss's version of Ultron."

Ultron should definitely be the guy to mess up the Avengers. From my POV, the thing that could be hardest to do in the new film would be to keep that conflict between the core cast (Thor, Cap, Tony, Bruce) since a lot of their arguments against each other were debunked in that final battle (Tony DID lay his life on the line etc). But I have full confidence Joss will have no problem making those guys hate each other five minutes in :)
Odds are that Tony creates Ultron. Creating the mass murdering bad guy is certainly a good starting point for friction within the group.
I think Jason_M_Bryant has it exactly right

Not enough time to introduce Hank Pym into the Avengers, have him create Ultron, and then be shunted aside for the rest of the movie. I also thought Iron Man 3 moved that ball down the field with AI driven suits. Those, along with existing Jarvis tech, seem to be the logical tipping point to something like Ultron

A Stark created Ultron also would serve as a way to gracefully remove Robert Downey from the series. I believe he's signed on for Avengers 2 & 3, but by the time those wrap he is likely done in that role for a variety of reasons.
Tony creating Ultron would make sense if if the speculation on Ant-Man () is true.
Jarvis definitely had a "H.A.L" vibe about him in Iron Man 3 - he pretty much had full control over everything (maybe even when Stark was in the suit?). So I really hope he "evolves" into Ultron. Seems like a no-brainer. Looking forward to Joss' take on that level of dangerous A.I anyway, given how well he dealt with the whole "Danger Room deals out the hurt" in Astonishing X-Men.
Any bets Ultron shoots Tony Stark in the spine?
